Terms of Service

1. Acceptance of Terms
By downloading, registering, or using the AfriHauler platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users including customers and transporters.
2. The Platform
AfriHauler is a marketplace that connects customers who need to move cargo with independent transporters operating in Ghana. We are a technology platform and are not a transport company. Transporters are independent contractors and not employees or agents of AfriHauler.
3. User Accounts
• You must be at least 18 years old to use the Platform. • You must provide accurate and complete information during registration. • You are responsible for maintaining the security of your account credentials. • You may not share your account with others or create multiple accounts. • AfriHauler reserves the right to suspend or terminate accounts that violate these Terms.
4. For Customers
• You may post jobs describing cargo, pickup and delivery locations, and your budget. • You are responsible for accurately describing the cargo, including weight, dimensions, and any special handling requirements. • You agree to be present or have an authorised representative available at pickup and delivery locations. • Payment is due upon job completion unless otherwise agreed. • You may not post jobs for illegal goods or prohibited cargo.
5. For Transporters
• You must be a licensed driver with valid documentation to register as a transporter. • You must provide accurate vehicle information and keep it up to date. • You are solely responsible for complying with all Ghanaian traffic laws and regulations. • You must have valid insurance coverage for your vehicle and cargo. • You agree to honour bids you submit once accepted by a customer. • AfriHauler may verify your documents and suspend your account if verification fails.
6. Payments
• Payment amounts are agreed between customers and transporters through the bidding process. • AfriHauler may charge a service fee on transactions conducted through the Platform. • In the event of a transporter breakdown mid-delivery, partial payment may be negotiated through the Platform's breakdown resolution feature. • Disputed payments will be reviewed by AfriHauler and a decision made at our discretion.
7. Cancellations
• Customers may cancel a job before a bid is accepted without penalty. • Cancellation after a bid has been awarded may incur a cancellation fee. • Repeated cancellations may result in account suspension. • Transporters who repeatedly fail to honour accepted bids may be removed from the Platform.
8. Prohibited Conduct
You may not use the Platform to: • Transport illegal goods, narcotics, weapons, or prohibited items under Ghanaian law • Engage in fraudulent activity or misrepresent yourself • Harass, threaten, or abuse other users • Circumvent Platform fees by conducting transactions off-platform • Use automated tools to scrape or misuse Platform data
9. Limitation of Liability
AfriHauler is a marketplace platform and is not liable for: • Loss, damage, or theft of cargo during transit • Delays caused by transporters or third parties • Disputes between customers and transporters • Any indirect, incidental, or consequential damages arising from use of the Platform Our total liability to you shall not exceed the amount of fees paid to AfriHauler in the 30 days preceding the claim.
10. Dispute Resolution
In the event of a dispute between a customer and transporter, both parties should first attempt to resolve it through the Platform's dispute feature. If unresolved, AfriHauler may mediate but is not obligated to make a binding decision. Disputes that cannot be resolved through the Platform are subject to Ghanaian law and jurisdiction.
11. Intellectual Property
All content on the Platform including logos, design, and software is the property of AfriHauler and protected under Ghanaian and international intellectual property laws. You may not copy, reproduce, or distribute any content without our written permission.
12. Changes to Terms
We reserve the right to update these Terms at any time. We will notify users of material changes via the app or email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved in the courts of Ghana.
